General Terms of the Online Shop

The present website and the online shop that sells online the DAS.4 Products (hereinafter the “Shop”) of the Société Anonyme under the name “TIMEBOX S.A.” (Tax Identification Number 800677963, Tax Office Commercial Companies’ Athens Office, based in Greece, at 48, Stadiou street, 105 64 Athens, Attica (hereinafter the “Company”). These General Terms of Transaction (hereinafter “GTT”) are intended to express in a clear, concise and comprehensible manner, in accordance with the principle of good faith and the provisions governing the validity of legal acts, the conditions governing and regulating the Company’s relations with each visitor and/or customer of the Shop, in accordance with Law 2251/1994 on “Consumer Rights”, in particular the provisions regarding distant trading and Law 2472/1997 on the “Protection of the individual against the unlawful processing of personal data”, as in force today.

Each time you login, navigate and make a transaction with our Shop makes you a visitor and/or customer of the Shop. Before you start browsing the Shop, please confirm that you have read and understood fully the present GTT and that you accept them, as well as that all uses and/or transactions hereinafter with the Company through the Shop presupposes your full and unconditional acceptance of these GTT.

Personal Data

The Company confirms that it will not utilise your personal data for any use not explicitly authorised by you, nor will it send or disclose the said data to third parties (natural persons or legal entities) not affiliated with the Company without your prior explicit and specific consent to do so, unless such disclosure is required for the processing of your order (e.g. collaborating courier companies) or is mandatory by law.

However, for the initiation and processing of our transaction, you will be required to provide certain personal data, such as your name and surname and your contact details, your payment details (e.g. your credit card number), the shipping address for your order etc. In addition, while navigating in the Shop using your personal DAS.4 account, the Company may collect information from your computer’s operational system, your browser and your IP address in order to count visits, to create order history and consumer interest for the purposes of service optimization or maintaining an internal accounting file.

Under-aged visitors may only have access to the Shop and its services pursuant to the consent and under the supervision of their parents or guardians, without any obligation to submit their own personal data. In case such personal data is submitted by under-aged persons, the Company immediately deletes the corresponding information.

The Shop allows its visitors/customers to have access to the file where their personal data are collected and stored according to the above and make any corrections, deletions, modifications and additions to the data or information they have submitted.

Security – Cookies – Links

For your safe navigation in the Shop and the security of your transactions with it, the Company takes all appropriate measures by adopting modern high-quality security standards in line with market trends, such as state-of-the-art encryption technology SSL (Secure Socket Layer) by Thawte set up during the introduction of sensitive personal data offering 256-bit encrypted communication. Please be advised that we do our best to protect your personal data and that Safe Browsing at our Shop as well as password protection in your DAS.4 personal account is also up to you.

In the Shop you may find links leading to other webpages, that are managed by third parties or belong to third parties (natural persons or legal entities), not affiliated with the Company or the Shop. In this case, it is clarified that the Company and the Shop are not responsible for any content of any linked website and their use by visitors/customers as they are beyond the control of the Shop and the Company. Indicating such links does not imply a statement by the Company regarding the reliability, security and content of the particular links, services and products provided through them and their use is the sole responsibility of the visitors/customers. Therefore, for any problem that may come up while navigating at those linked websites or in relation to your transactions with these, please contact directly their administrators, who bear sole responsibility for such websites.

Items Sold

The products sold through the Shop are the products of the Company (hereinafter, the “Products”). The characteristics and other accompanying information (e.g. any product warranty, identity, any instructions, etc.) of the products that are sold are available and you may consult these by following the instructions available in the Shop by clicking on the name of the respective product. The prices indicated on the relevant catalogues next to each product include VAT (24%). The said prices refer to the Products and the quantity of Products available in the Company’s warehouse, while the Shop reserves the right to adjust prices without prior notice.

Submitting/Cancelling an Order

Submitting a Product order constitutes a binding purchase offer of the said Products to the total price indicated during the order submission, including V.A.T., packing and shipping expenses, other applicable fees and any discount to which you are entitled as visitor/customer. Your order is completed upon acceptance from the Company through a confirmation email at the email address you indicated upon submission of the said order. If you do not receive a confirmation message of your order, please contact immediately the Shop at info@das-4.com to request the successful completion of your order’s submission.

The Shop uses a system for cancelling orders (partly or fully) that have already been registered but not delivered. To cancel an order (partly or fully) please email info@das-4.com or call 210 32 12 293. You can do so until we inform you that your order has been dispatched. After this time, you cannot cancel your order.

Payment

The payment of each order is absolutely safe using any bank’s VISA and MASTERCARD credit cards using the SSL (Security Certificate & SSL Technology) Security Protocol, and its confirmation is achieved using the 3D Secure Network by VISA and MASTERCARD. Furthermore, you can also pay safely by Cash upon Delivery.

The Shop has taken all necessary precautions to secure transactions by means of credit card. However, in case of confirmed fraudulent use of your credit card, you may cancel charge of your account upon submitting a request to the Bank that issued your credit card, which is obliged to investigate your complaint. Therefore, you are obliged to immediately notify the issuing bank as soon as you realize such an event has occurred in order for to cancel the card and prohibit its use by unauthorized persons.

Means, Time and Cost of Dispatch

The quality of the Products is excellent, complying with the international quality standards and Timebox SA design, they are carefully packed and are immediately available for delivery at the Company’s premises. Should you indicate so upon submission of your order, the Products may be shipped to you at your expense and liability by courier at the latest within 10 days from the date of your order confirmation at the location you have indicated upon submission of your order. Dispatch takes place daily, excluding Saturdays, Sundays and Public Holidays. Shipping fees are fixed for shipping throughout Greece and vary solely depending on the weight of the Products you ordered.

Dispatch time of the Products is subject to availability of the ordered products within the Shop’s warehouse and to force majeure (e.g. bad weather conditions, strikes etc.).

Prices of Products Sold

The prices indicated on the relevant catalogues next to each product include VAT (24%). The said prices refer to the Products and the quantity of Products available in the Company’s warehouse, while the Shop reserves the right to adjust prices without prior notice

Withdrawal – Product return

General Terms for Returns

Returns to the eshop are accepted within fourteen (14) days of the date of dispatch, with return.
The product or products must be in a similar condition to their condition when you received them, and they should not have been used, worn, soiled, or be in any condition other than their original; the tab must not have been removed.

If the product is returned to the eshop, you should necessarily inform us via email for the return. During the sales, discount items are only exchanged with other discount products, and the products that are throughout the year can only be exchanged with same category products. The returned products can be exchanged with a product of different type, size or colour, or you may request cash refund. We refund the amount paid for the product, including discount products. You are responsible for the products you return to us until we receive them. Make sure that they are properly packaged and that they are not subject to damage during transport. Cash refund is not available for purchases made or products sent as gifts. Returns we receive that do not comply with the conditions of our policy will not be accepted. How do I return the product to the eshop?

If you want to return a product, please first contact the Customer Service Department at info@das-4.com stating your order number, the product or products you want to return and the reason for returning them. Please return the package to our warehouse, address: 48, Stadiou street, 105 64, Athens, Attica.

Returning a defective product

All DAS.4 Products undergo strict quality controls. However, if you detect any problem and the product you received is defective, you should follow the steps below:
– Contact us either by calling us on 210.32 12 293 or via e-mail at info@das-4.com
– In case of refund, this will depend on the payment method of the initial purchase, i.e. cash upon delivery will be refunded to the bank account you stated in the return form, credit / debit card payment will be refunded to your card.

How much money will be refunded?

We will refund the amount corresponding to the value of your products.

Intellectual and Industrial Property Rights

Excluding any explicit exceptions (intellectual rights of third parties, associates and authorities), the entire content of the website, including pictures, graphics, photographs, designs, texts, overall layout, services provided and Products, and in general all files of the Shop are the intellectual property, industrial designs, tradenames, distinctive marks, signs, symbols and registered trademarks and service marks of the Company, its affiliated companies and businesses and its providers, and are protected by the relevant provisions of Greek and European law as well as those of international agreements. Any other product or service mentioned in the Shop bearing trademarks of the respective organizations, companies, associates, authorities, unions or publishers constitute their own intellectual and industrial property and therefore they bear the liability.

Liability of Parties

All visitors/customers, when accepting these GTT and browsing our Shop, state that they have the legal right to conclude this agreement and use the Shop according to the terms and conditions stated herein. Moreover, as a visitor/customer of the Shop you agree and accept that you have the financial responsibility of using the Shop as well as the use of the DAS.4 account by others, including people living with you, so you agree to supervise any use of the Shop by minors using your DAS.4 account or your name. The Company, including its consultants and employees, is solely is solely liable for fraud and gross negligence and solely for damages incurred and its liability may not exceed the value of the sold Products.

Applicable Law and Other Terms

The Company and the Shop reserve the right to modify or renew in writing the present GTT without notice, which will be valid from the date of their posting in the Shop. Failure to exercise any right of the Company may not be construed as a waiver thereof.

Navigating, using and making transactions in the Shop is governed by Greek law, the law of the European Union, and the relevant international conventions. Any dispute arising while you navigate, use or make transactions with the Shop shall be subject to the jurisdiction of the competent courts of Athens, Greece.

If any provision of the aforementioned terms conflicts with the law, it will automatically cease to be in force and removed from the present without in any way prejudicing the effect of the other terms.

Online Dispute Resolution

The Company, complying with Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes, Directive 2013/11/EU of the European Parliament and of the Council on alternative dispute resolution for consumer disputes and Ministerial Decision No. 70330οικ. (Government Gazette vol. B’ 1421/2015), informs you that you have the right to out-of-court dispute settlement of any dispute related to your transactions with the Store through the European Online Dispute Resolution (ODR) platform
